Art. 4º Fines



Constituyen los fines de la Asociación:

Los elefantes encabezan la lista de especies animales amenazadas en el mundo. Si no les ayudamos a sobrevivir, pronto se extinguirán.
Se estima que sólo unos 400.000 elefantes siguen vivos, 30.000 de ellos en Asia. Por el codiciado marfil, 30.000 elefantes son sacrificados cada año. El comercio de animales vivos con animales jóvenes, la caza de trofeos y el aumento de los conflictos entre humanos y animales constituyen una amenaza. No debemos permitir que esto ocurra.
Al menos 10.000 elefantes viven sus vidas en cautiverio. Durante horas se utilizan en condiciones de vida catastróficas (encadenados, sin apenas sombra, poca agua…) para fines turísticos y religiosos en espectáculos, circos, zoológicos.

Para ello damos conferencias, por ejemplo, en escuelas y otras instituciones públicas – mostramos la realidad a menudo brutal, pero también cómo se puede apoyar el incipiente cambio de conciencia en Asia – con nuestros propios documentales de cine y fotografía.

CAPITULO II.- PERSONAS ASOCIADAS

Art. 6º Capacidad

Podrán formar parte de la Asociación todas las personas físicas y jurídicas que, libre y voluntariamente, tengan interés en el desarrollo de los fines de la asociación con arreglo a los siguientes principios:

  1. Las personas físicas con capacidad de obrar y que no están sujetas a ninguna condición legal para el ejercicio del derecho.

  2. Los menores no emancipados de más de catorce años de edad deben contar con el consentimiento documentalmente acreditado, de las personas que deban suplir su capacidad.

  3. Las personas jurídicas, previo acuerdo expreso de su órgano competente.

Deberán presentar una solicitud por escrito al órgano de representación, y éste resolverá en la primera reunión que celebre; si el solicitante se ajusta a las condiciones exigidas en los estatutos, el órgano de representación no le podrá denegar la admisión.

La condición de persona asociada es intransmisible.

Art. 7º Derechos de las personas asociadas

Los derechos que corresponden a las personas asociadas son los siguientes:

  1. A participar en las actividades de la Asociación y en los órganos de gobierno y representación, a ejercer el derecho de voto, así como a asistir a la Asamblea General, de acuerdo con los Estatutos. Para poder ser miembro de los órganos de representación es requisito imprescindible ser mayor de edad, estar en pleno uso de los derechos civiles y no estar incurso en los motivos de incompatibilidad establecidos en la legislación vigente.

  2. A ser informadas acerca de la composición de los órganos de gobierno y representación de la Asociación, de su estado de cuentas y del desarrollo de su actividad. Podrán acceder a toda la información a través de los órganos de representación.

  3. A ser oídas con carácter previo a la adopción de medidas disciplinarias contra ellos y a ser informado de los hechos que den lugar a tales medidas, debiendo ser motivado el acuerdo que, en su caso, imponga la sanción.

  4. A impugnar los acuerdos de los órganos de la Asociación que estime contrarios a la Ley o a los Estatutos.

  5. A conocer los Estatutos y los reglamentos y normas de funcionamiento aprobados por los órganos de la Asociación. Asimismo, tendrán derecho a que se les facilite copia de los Estatutos vigentes y del Reglamento de Régimen Interno de la Asociación, si existiese.

Art. 9º Causas de baja

Son causa de baja en la Asociación:

  1. La propia voluntad del interesado/a, comunicada por escrito a los órganos de representación.

  2. A partir de 2 cuotas no satisfechas será motivo de baja.

CAPITULO III.- EL ÓRGANO DE GOBIERNO

Art. 11º La Asamblea General

La Asamblea General es el órgano supremo de gobierno de la Asociación, integrado por todas las personas asociadas por derecho propio irrenunciable y en igualdad absoluta, que adopta sus acuerdos por el principio mayoritario o de democracia interna.

Todos los miembros quedarán sujetos a los acuerdos de la Asamblea General, incluso los ausentes, los disidentes y los que aún estando presentes se hayan abstenido de votar.

Art. 12º Reuniones de la Asamblea

La Asamblea General se reunirá en sesión ordinaria como mínimo una vez al año, en el PRIMER trimestre.

La modalidad de la reunión podrá ser: Presencial, por Skype o videoconferencia.

La Asamblea General se reunirá con carácter extraordinario siempre que sea necesario, a requerimiento de un número de personas asociadas que represente, como mínimo, un diez por ciento de la totalidad.

L’Association exercera principalement ses activités en Espagne, ainsi qu’en Europe et dans le reste du monde.

Art. 4 – Objectifs

Les objectifs de l’Association sont les suivants

Les éléphants sont en tête de la liste des espèces animales menacées dans le monde. Si nous ne les aidons pas à survivre, ils disparaîtront bientôt.

On estime que seuls 400 000 éléphants sont encore en vie, dont 30 000 en Asie. Pour l’ivoire tant convoité, 30 000 éléphants sont massacrés chaque année. Le commerce de jeunes animaux vivants, la chasse aux trophées et l’augmentation des conflits entre l’homme et l’animal constituent une menace. Nous ne devons pas permettre que cela se produise.

Au moins 10 000 éléphants vivent leur vie en captivité. Pendant des heures, ils sont utilisés dans des conditions de vie catastrophiques (enchaînés, avec peu d’ombre, peu d’eau…) à des fins touristiques et religieuses dans des spectacles, des cirques et des zoos.

Pour dresser les éléphants, on les enlève à leur mère lorsqu’ils sont bébés. Seuls et enchaînés, sans nourriture, ils sont battus, frappés et torturés pendant des jours jusqu’à ce que leur volonté soit brisée. Beaucoup ne survivent pas à cette épreuve.

Leur nouveau compagnon est le Bull Hook – le crochet de fer pointu. Ainsi, l’homme garde le contrôle sur l’éléphant, ce qui se voit dans les oreilles arrachées et les nombreuses cicatrices des animaux maltraités.

Beaucoup de gens ne le savent pas. C’est pourquoi nous devons informer les gens – nous devons leur expliquer ce qui se cache derrière le tourisme des éléphants, ce que les animaux doivent endurer, les tortures auxquelles ils sont exposés.

Les éléphants sont des animaux très intelligents et ressemblent aux humains dans leur comportement et leurs émotions. La terre a besoin des éléphants comme jardiniers pour la distribution des semences et le défrichage des forêts. Si les éléphants sont absents, la biodiversité diminue. Il faut également souligner ce problème.

Et NOUS devons sensibiliser en particulier nos jeunes et nos enfants – en tant que guardiens de leur avenir – pour qu’ils prennent cette responsabilité sur leurs épaules.

CHAPITRE II – PERSONNES ASSOCIÉES

Art. 6 Capacité
May become members of the Association all physical and moral persons who, freely and voluntarily, are interested in the development of the Association’s objectives according to the following principles:
a) Les personnes physiques ayant la capacité d’agir et qui ne sont soumises à aucune condition légale pour l’exercice de ce droit.
b) Les mineurs non émancipés de plus de quatorze ans doivent avoir le consentement documenté des personnes qui doivent substituer leur capacité.
c) Les personnes morales, sous réserve de l’accord exprès de leur organe compétent.
They must submit a written request to the representative body, which shall decide at the first meeting it holds; if the applicant meets the conditions required by the Articles of Association, the representative body may not refuse admission.
La qualité de membre est intransmissible.

Art. 7 Rights of the members
Les droits correspondant aux membres sont les suivants :
a) Participate in the activities of the Association and in the bodies of management and representation, exercise the right to vote, and attend the General Assembly in accordance with the Articles of Association. Pour être membre des organes représentatifs, il est indispensable d’être majeur, d’avoir la volle jouissance de ses droits civils et de ne pas être soumis aux motifs d’incompatibilité établis dans la législation en vigueur.
b) Être informé de la composition des organes de direction et de représentation de l’Association, de ses comptes et du développement de son activité. Ils ont accès à toute information par l’intermédiaire des organes de représentation.
c) Être entendus avant l’adoption de mesures disciplinaires à leur encontre et être informés des faits qui donnent lieu à ces mesures, ainsi que des motifs de la résolution qui, le cas échéant, impose la sanction.
d) Contester les résolutions des organes de l’Association qu’ils estiment contraires à la loi ou aux statuts.
e) Connaître les Statuts et les règlements et règles de fonctionnement approuvés par les organes de l’Association. De même, ils ont le droit d’obtenir une copie des statuts en vigueur et du règlement intérieur de l’Association, le cas échéant.
f) Consulter les livres de l’Association.

Art. 9 Causes de sortie de l’Association
Les causes de sortie de l’Association sont les suivantes
a) La volonté propre de l’intéressé, communiquée par écrit aux organes de représentation.
b) Après deux ou plus de deux cotisations impayées, l’Association est annulée.

CHAPTER III.- L’ORGANE DE DIRECTION

Art. 11 L’Assemblée générale
L’Assemblée Générale est l’organe suprême de l’Association, composée de tous les membres dans leur droit inaliénable et en égalité absolue, qui adopte ses résolutions selon le principe de la majorité ou de la démocratie interne.
Tous les membres sont soumis aux résolutions de l’Assemblée générale, y compris les absents, les dissidents et ceux qui, bien que présents, se sont abstenus de voter.

Art. 12 Réunions de l’Assemblée
L’Assemblée générale se réunit en session ordinaire au moins une fois par an, au cours du premier trimestre.
La forme de la réunion peut être : En face à face, par Skype ou par vidéoconférence.
The General Meeting shall hold an extraordinary meeting each time it is necessary, at the request of a number of members representing at least six percent of the total number of members.

CHAPTER IV.- L’ORGANE DE REPRÉSENTATION

Art. 15 Composition of the representative body
L’Association est gouvernée, administrée et représentée par l’organe représentatif dénommé CONSEIL D’ADMINISTRATION, composé de la Présidente, Mme Martina SCHICKHOFF, du Conseil d’Administration et des membres suivants
SCHICKHOFF, membre : Julia Ingrid Päule Emmely MANZAU, et Trésorier/Secrétaire : Mathias Alfons SCHICKHOFF.

L’élection des membres de l’organe représentatif se fait au scrutin libre et secret des membres de l’Assemblée générale. Les candidatures seront ouvertes, c’est-à-dire que tout membre pourra se présenter, étant des conditions essentielles : être majeur, avoir le plein usage des droits civils et ne pas encourir les motifs d’incompatibilité établis dans la législation en vigueur, étant élus pour les postes de Président, Secrétaire et Trésorier les candidats qui auront obtenu le plus grand nombre de voix et dans cet ordre.
Les fonctions de Président et de Secrétaire doivent être exercées par des personnes différentes.
L’exercice des fonctions est gratuit.
